Terms of Service

Nature of service
ZEROSPAM agrees to provide email filtering services to the customer in the form of protection against spam, viruses and phishing. The customer understands and agrees that ZEROSPAM will direct his or her email to ZEROSPAM's servers and then send them to their final destination on the customer's or provider's IT environment.
Transmission time
Under normal conditions, between 8 a.m. and 5 p.m., the maximum delay incurred by the passage of email through ZEROSPAM's servers is approximately two (2) minutes.
Limitation of liability
ZEROSPAM shall not be liable for lost, bounced or delayed email, irrespective of the cause. The customer's recourse shall in no event exceed the value of the service, prorated to the number of hours that the service was unavailable.
Filtering rules
By subscribing to ZEROSPAM's email filtering service, the customer agrees that its filtering rules are determined by ZEROSPAM's administrators and are modified, as required, in order to optimize the service's effectiveness. This provision also applies to clients who have signed up for a free trial period.
Anti-virus service
ZEROSPAM undertakes to intercept computer viruses, worms and phishing that it has detected and that may be contained in email intended for the client. However, ZEROSPAM does not offer any guarantee as to virus detection or detection time of new threats. ZEROSPAM recommends that customers retain a secondary anti-virus protection program in their IT environment.
ZEROSPAM undertakes to send a weekly report of viruses intercepted for the client's filtered domain(s) to an administrator designated by the customer.
Confidentiality
ZEROSPAM undertakes to guarantee the confidentiality of all of its customers' communications and will never record, archive or reproduce them in any shape or form. ZEROSPAM is entirely compatible with encrypted communications and Transport Layer Security (TLS) protocol. ZEROSPAM also undertakes to guarantee the confidentiality of its clients' list of electronic addresses and will never disclose, share or sell them to a third party.
Message log
ZEROSPAM agrees to keep a client communications log that will remain confidential and will only be used for statistical or investigative purposes. Upon request, customers may obtain access to their message log.
Invoicing
ZEROSPAM invoices are sent on a quarterly basis. Invoices are payable net thirty (30) days from the date of the invoice. Lack of payment may result in discontinuation of service without further notice.
Final address list
ZEROSPAM's billing is based on the number of email addresses corresponding to final destinations. The cost of service may be raised or lowered twice a year, according to the actual number of active email addresses. ZEROSPAM therefore reserves the right to ask the customer for a list of its email addresses twice a year. For billing purposes, aliases are not considered as final email addresses.
Cancellation of service
The customer may cancel the service at any time by written notice. Cancellation notices take effect at midnight on the last day of the month following the month in which the cancellation notice was received by ZEROSPAM. All service fees for the final month are due immediately.

ZEROSPAM's customers have 24/7 access to a multilingual hotline for technical support.
Transfer
Under this agreement, ZEROSPAM may transfer its rights to any party in the event of a full or partial transfer, sale or merger of the company or its activities.
Consent to terms and conditions
By keeping MX records pointed to ZEROSPAM's services, the customer is consenting to the terms and conditions of service. However, altering MX records so that they no longer point to ZEROSPAM's servers does not constitute a valid cancellation notice, and ZEROSPAM will therefore continue to bill for its services until a written cancellation notice is received.
